Federal Court Orders Freedom of Kilmar Abrego Garcia from Immigration Custody
A court has ordered the immediate release of Kilmar Abrego Garcia from immigration custody, concluding his ongoing detainment is without lawful basis.
"Since Abrego Garcia's release after erroneous imprisonment in El Salvador, he has been re-detained, again without legal justification," Judge Paula Xinis wrote in her ruling.
The situation originates in a mistaken deportation to El Salvador in March, which US authorities later acknowledged was an error. After his repatriation to the United States to answer human smuggling allegations, he was held in immigration custody.
In her order, the judge pointed out that the authorities does not have a valid deportation order, which effectively blocks them from deporting Mr. Abrego Garcia "at this time."
